Practice Overview Martin Clearwater & Bell LLP has substantial experience representing a diverse range of medical and health product manufacturers and distributors as well as medical device and pharmaceutical manufacturers in lawsuits, including those alleging dangerous or defective products. The Firm has litigated such matters in both Federal and State venues. MCB has developed an intense knowledge of regulatory issues encompassing areas of drug investigation, through FDA approval and marketing. The Firm has litigated matters ranging from marketed products to those still in the investigatory phase. MCB’s expertise includes traditional malpractice suits filed by individual claimants to mass litigation involving hundreds of plaintiffs. MCB served as the lead defense firm for physicians defendants in the New York State “Fen/Phen” diet drug litigation. In this capacity, the Firm represented the vast majority of physicians and hospitals named in the litigation. MCB also acts as liaison counsel for the medical defendants as part of the Defense Steering Committee. The Firm closely monitors all developments in the Federal Multi-District litigation proceedings and in other jurisdictions nationally. MCB’s expertise also extends to litigation regarding silicone breast implants. In 1992, the FDA ordered the suspension of the use of silicone breast implants. This resulted in an explosion of litigation in both Federal and State courts against the manufacturers of the implants and many of the physicians who had implanted them. Recognizing the special problems for physicians in this litigation, MCB developed an expertise in the law, the medical practice and the products. The Firm understands that a complete knowledge of the products and their components is critical to the preparation of an appropriate defense. MCB mastered the law and the science and became lead counsel on the silicone breast implant issues to the largest liability carrier insuring physicians in New York. In this role, MCB serves as liaison to the Multi District Litigation, monitoring the Dow-Corning bankruptcy and supervising all of the silicone breast litigation for that carrier in the State of New York.
