Partner John Bugliosi and Associate Adam Brown obtained a defense verdict in an osteomyelitis case venued in Westchester County. In this matter, the then 68-year old plaintiff alleged a delayed diagnosis of osteomyelitis following foot surgery (Lapidus) by our client, a foot and ankle orthopedic surgeon, which resulted in 5 additional surgeries including to eradicate the infection and a revision to attempt to fuse the first TMT joint. Plaintiffs' counsel requested $3 million in damages during summation but the jury rendered a unanimous verdict in favor of our client after deliberating for just under one hour.
