Senior Trial Partner Peter Crean and Partner Emma Glazer obtained summary judgment in an ENT case. This case involves the alleged delay in diagnosis of methotrexate toxicity, when the medication was prescribed by an outside provider. The patient presented with mouth ulcers and our insured ENT physician recognized they were symptoms of methotrexate toxicity and he discontinued the medication. The plaintiff claimed that our doctor should have ensured the patient's PCP saw him that day, even after the ENT called him. However, plaintiff's expert failed to provide any expert opinion regarding proximate cause. As such, the court granted our motion for summary judgment and dismissed this case as to our defendants with prejudice.
