Senior Trial Partner Laurie A. Annunziato, Partner Amy E. Korn and Senior Associate Gabrielle F. Murray secured Summary judgment on behalf of our academic medical center client and physician in a case involving a pro se plaintiff who alleged that our client physician negligently required the plaintiff to seek neurology clearance following a car accident caused by loss of consciousness and potential seizure activity. Plaintiff also alleged that our client physician failed to accurately complete DMV forms which would have restored the plaintiff's driver's license following the accident.
MCB submitted an expert affirmation of a board certified physician in internal medicine in support of our motion for summary judgment, which was granted in its entirety. The Court held that the doctor did not depart from the standard of care or proximately cause the plaintiff’s alleged injuries. MCB also secured dismissal of plaintiff’s claims for intentional infliction of emotional distress, and negligent infliction of emotional distress.
