Senior Trial Partner Daniel L. Freidlin obtained summary judgment in a Cesarean section case involving a young woman under the care of our client obstetrician and his group. The patient had a prior history of two Cesarean sections and ultrasound detected placenta previa. She was scheduled for a repeat Cesarean section. During delivery,a placenta accreta was detected and the patient sustained a massive hemorrhage that could not be controlled. The claim against our client obstetrician was a failure to refer the decedent to a maternal fetal medicine specialist and delivery at a tertiary facility. We argued that the pre-surgical planning was appropriate and the responsibility of the delivering obstetrician. The Court granted our motion for summary judgment.
